DHS Cash Receipt and Bond Refunding

DHS Cash Receipt and Bond Refunding

Sometimes people post a Cash Bond directly with the Department of Homeland Security (formerly INS) to obtain a noncitizen’s release. However, when the case is completed, they may have a problem securing a prompt bond refund from DHS especially if the original paperwork has been lost if bond posted before 9/1/2020. DHS normally takes 6-8 weeks, or even months to process a refund.

Gonzales & Gonzales Immigration Bond’s first recommendation to clients is always to post cash through our company as we routinely issue a refund check within three (3) business days after the Bond Cancellation form is received.

If you have deposited funds directly with DHS for an immigration bond, we have a program whereby we can refund the bond amount to you, less a small processing fee. If you have the “Notice – Immigration Bond Cancellation” form I-391 and the “Receipt of Immigration Bond” from I-305, we can advance the refund.

Refunding Bond & Release FAQs

Here are some commonly asked questions regarding refunding bonds and releases:

What is a refunding bond?

A refunding bond is a type of bond issued to refinance an existing bond. It’s primary purpose is to take advantage of lower interest rates to reduce the cost of borrowing. This process involves the issuance of new bonds at the current lower interest rates, using the proceeds to pay off the older, higher-interest bonds. Refunding can lead to significant savings for the issuer over time. In the context of immigration bonds, a refunding bond might not be directly applicable. However, individuals might seek a refund of cash bonds posted with the Department of Homeland Security for an immigration case once it is completed. This process can be lengthy, taking 6-8 weeks or more.

What is a refunding bond and release?

In the scenario of immigration bonds, a “release” refers to the discharge of the noncitizen from detention upon posting a cash bond. After the immigration case concludes, securing a prompt refund from the Department of Homeland Security can be challenging, especially if paperwork is lost. Companies like G&G Immigration Bonds offer services to speed up this refund process, issuing refunds within three business days after receiving the Bond Cancellation form, which helps to minimize the hassle and time that goes into this process.

When do interest rates rise for bond refunding?

Interest rates for bond refunding rise when the overall interest rate environment increases. However, bond refunding typically occurs when interest rates fall, allowing issuers to refinance their existing debt at a lower cost. The decision to refund bonds is influenced by market conditions and the issuer’s financial strategy. If interest rates rise, the opportunity for cost-saving through refunding diminishes, making it less attractive for issuers. In the case of immigration bonds, interest rates are not directly relevant to the refund process, but the efficiency and speed of obtaining refunds can be critical for those who have posted cash bonds.

Bond refunding typically occurs when?

Bond refunding typically occurs when interest rates have declined since the issuance of the original bonds, presenting an opportunity for issuers to lower their borrowing costs. By issuing new bonds at the current lower rates, the proceeds can be used to redeem the older, higher-interest bonds. This strategic financial move can significantly reduce interest expenses over time. For those dealing with immigration bonds, the focus might be more on the refund process after an immigration case concludes. For bonds posted directly with the DHS before 9/1/2020, securing a prompt refund can be challenging, with processes taking 6-8 weeks or longer, especially if there is lost paperwork. Utilizing services that offer to expedite refunds can provide a quicker resolution, often within a few business days.
